Terms and Conditions

1. Service Description

MyBuildRecords is a cloud-based document management service for residential builders. The service allows you (the builder) to collect, organize, and distribute building documentation to your homeowner clients. MyBuildRecords does not process, verify, or validate compliance documents; it is purely a hosting and distribution platform.

2. Your Account & Trial

You may create one account and begin your first project at no cost for seven (7) days. After the trial period, you will be invoiced NZ$300 per project. You are responsible for maintaining the confidentiality of your login credentials. You may cancel at any time.

3. Builder Responsibility for Compliance

You remain solely and exclusively responsible for all compliance with all local, regional, and national regulations, codes, and standards applicable to your building projects. This includes but is not limited to:

• Building codes and standards (NZ Building Code, Building Standards Act, or equivalent in your jurisdiction)
• Planning and resource consents
• Health and safety regulations
• Professional certification and producer statements
• Record retention and documentation requirements

MyBuildRecords is a document storage tool only. We do not verify, validate, or certify that any documentation meets regulatory requirements.

4. Limitation of Liability

MyBuildRecords accepts no responsibility or liability for any failure, loss, or damage arising from:

• Your failure to keep, maintain, or organize adequate records
• Your failure to collect compliance documentation
• Your failure to comply with any local, regional, or national regulations or codes
• Any regulatory inspection, audit, or enforcement action
• Any penalties, fines, or sanctions imposed on you
• Loss of data or service unavailability, except to the extent required by law

To the maximum extent permitted by law, our total liability to you for any claims is limited to the amount you paid for the service in the month the claim arose.

5. Acceptable Use

You agree not to use MyBuildRecords to:

• Upload illegal content or content that infringes third-party rights
• Attempt to breach security or gain unauthorized access
• Resell or redistribute the service without permission
• Interfere with the service or its infrastructure

6. Intellectual Property

You retain all rights to your documents and data. MyBuildRecords retains all rights to its software, interface, and design. You grant us a worldwide, non-exclusive license to store, process, and display your data to provide the service to you and to your authorized project users (subcontractors, homeowners).

7. Termination & Data Retention

You may cancel your account at any time. Projects and documents are retained for three (3) years from project creation date. After that period, data may be deleted without notice.

8. Changes to Terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance.

9. Governing Law

These terms are governed by the laws of New Zealand. You also acknowledge these terms are compliant with the Australian Consumer Law and equivalent consumer protection regimes in Australia. Any disputes shall be resolved in the courts of New Zealand.
